The author retraces the legal story of “exploitation” showing how its aims are hindered by a concept of the value of the cultural heritage that remains too limited to “face value”. He proposes a notion of “exploitation value” on which to base innovative products and processes that will satisfy the new needs of personal demand, the public and private sector involved in the safeguarding and compatible use of the heritage, the companies for which the cultural capital may be a beneficial factor and offer a competitive advantage and areas anxious for promotion.
